USCIS’s memo targets immigrants who entered legally and qualify for permanent residency, forcing them to leave the U.S. to obtain their green cards. Congress created adjustment of status precisely to allow eligible individuals to become permanent residents without uprooting their families, jobs, and communities.
Republican and Democratic administrations alike have implemented this process for decades, and courts have repeatedly upheld it. Reversing settled law by memo is legally questionable and needlessly chaotic.
